1. About the Service

Petsona is an AI-powered pet image generation service. Users may upload images of pets and use purchased credits to generate and download AI-created pet images.

The Service is intended for pet images only. The Service is not intended for human portraits, human identity editing, adult content, or any unlawful or harmful use.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase credits or use paid features of the Service.

By using the Service, you represent that you have the legal right and authority to agree to these Terms.

3. Accounts and Security

You may need to provide an email address or create an account to purchase credits, access generated images, or use certain features.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Please contact us immediately if you believe your account has been compromised.

4. Credits and Purchases

The Service may offer paid credit packages, including:

• $10 for 10 downloadable generated pet images
• $50 for 70 downloadable generated pet images

5. Payment Processing

Payments are processed by Dodo Payments, our merchant of record and payment provider. We do not directly process or store your full card number or payment credentials.

By completing a purchase, you may also be subject to Dodo Payments' buyer terms, payment policies, and related checkout terms.

6. No Refunds

All purchases are final and non-refundable, except where required by applicable law or where Dodo Payments processes a refund under its own payment, dispute, or chargeback procedures.

Please review your order carefully before completing your purchase.

7. User Content

"User Content" means any images, files, text, prompts, instructions, or other materials that you upload, submit, or provide to the Service.

You retain ownership of your User Content. By uploading User Content, you grant us a limited, non-exclusive, worldwide license to host, store, process, reproduce, modify, and use your User Content solely as needed to provide, operate, maintain, secure, and improve the Service.

You represent and warrant that:

• You own or have the necessary rights to upload and use the User Content.
• Your User Content does not violate any law or third-party rights.
• Your User Content does not contain human faces, human portraits, or images of real people.
• Your User Content does not contain illegal, harmful, abusive, sexual, or infringing material.

8. Generated Images

"Generated Images" means images created by the Service based on your User Content, prompts, templates, or instructions.

Subject to your compliance with these Terms, you may use Generated Images for personal or commercial purposes.

However, you are solely responsible for how you use Generated Images. We do not guarantee that Generated Images are unique, exclusive, free of third-party rights, suitable for trademark use, or legally cleared for every commercial purpose. You should obtain legal advice before using Generated Images in sensitive commercial contexts, including branding, advertising, merchandise, or trademark applications.

9. Prohibited Uses

You may not use the Service to create, upload, generate, download, distribute, or promote content that includes or relates to:

• Human portraits, human faces, or real-person identity editing.
• NSFW, pornographic, sexually explicit, or sexually suggestive content.
• Sexual content involving minors or any content that exploits or harms children.
• Non-consensual intimate imagery or deepfake sexual content.
• Violence, abuse, harassment, hate, threats, or illegal activity.
• Celebrity impersonation, public figure deception, fraud, scams, or misleading identity use.
• Copyright, trademark, privacy, publicity, or other intellectual property infringement.
• Unauthorized use of third-party characters, brands, logos, or protected creative works.
• Malware, phishing, spam, or attempts to interfere with the Service.
• Any use that violates applicable law, platform rules, payment processor rules, or these Terms.

10. AI Output Limitations

AI-generated images may be inaccurate, unexpected, distorted, incomplete, or unsuitable for your intended use. Results may vary based on the quality of uploaded pet images, templates, prompts, and system limitations.

We do not guarantee that the Service will produce a specific result, style, quality level, or likeness.

11. Storage and Deletion

Uploaded pet images and generated images may be stored for up to 3 months to provide access, downloads, support, abuse prevention, and service reliability.

After that period, content may be deleted from active systems, although backup copies may remain for a limited time where necessary for security, legal, or operational reasons.

12. No Model Training

We do not use your uploaded pet images or generated images to train our own AI models unless you give us explicit permission.

13. Intellectual Property

The Service, including its website, software, design, templates, branding, text, graphics, and other materials, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, reverse engineer, resell, or exploit the Service except as expressly permitted by these Terms.

14. Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time. We may also update pricing, credit packages, templates, features, or usage limits.

We are not liable for any interruption, delay, loss of data, or unavailability of the Service.

15. Termination

We may suspend or terminate your access to the Service if we believe you have violated these Terms, created risk for other users, abused the Service, violated payment processor rules, or used the Service unlawfully.

16. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to us for the purchase giving rise to the claim.

18. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, losses, and expenses arising from your User Content, your use of Generated Images, your violation of these Terms, or your violation of any law or third-party rights.
